Fitte Privacy Policy

Deze Privacyverklaring is voor het laatst herzien en gewijzigd op 19-09-2023.

Onze Privacyverklaring beschrijft en is van toepassing op de zakelijke activiteiten van Fitte, waaronder, maar niet beperkt tot, het verzamelen en verwerken van persoonlijke gegevens van bezoekers, gebruikers en klanten van de Fitte-website. Deze Verklaring heeft betrekking op elke interactie tussen hen en de communicatiekanalen van Fitte, zowel online via de website en sociale media-accounts als offline via eventueel gespecificeerde activiteiten en andere mogelijke diensten.

Wij gebruiken uw persoonlijke gegevens om de dienst te leveren en te verbeteren. Door de dienst te gebruiken, stemt u in met het verzamelen en gebruiken van informatie volgens deze Privacyverklaring.

Het respectvol en wettig behandelen van onze klanten is van groot belang voor Fitte, evenals de transparante communicatie over hoe we uw privacy en persoonlijke gegevens beschermen en beveiligen. Deze Privacyverklaring beschrijft gedetailleerd hoe we deze bescherming en beveiliging waarborgen. Wij verwerken persoonsgegevens in overeenstemming met de Algemene Verordening Gegevensbescherming van de EU (EU 2016/679), de California Consumer Privacy Act en/of andere lokale privacywetten (indien van toepassing).

Deze Privacyverklaring wordt regelmatig bijgewerkt om veranderingen in privacywetten weer te geven. Om ervoor te zorgen dat u op de hoogte bent van onze updates, zullen we eventuele wijzigingen communiceren via e-mail.

1. Definities

Voor de doeleinden van deze Privacyverklaring:

- "Account" betekent een uniek account dat voor u is aangemaakt om toegang te krijgen tot onze Dienst of delen van onze Dienst.
- "Bedrijf", ook aangeduid als "ons", "wij", "onze", verwijst naar Fitte. Voor de doeleinden van de AVG is het Bedrijf de Verwerkingsverantwoordelijke.

- "Cookies" zijn kleine bestanden die door een website op uw computer, mobiele apparaat of een ander apparaat worden geplaatst en de details van uw browsegeschiedenis op die website bevatten, naast vele andere toepassingen.
- "Verwerkingsverantwoordelijke", voor de doeleinden van de AVG (Algemene Verordening Gegevensbescherming), verwijst naar het Bedrijf als de rechtspersoon die alleen of gezamenlijk met anderen de doeleinden en middelen voor de verwerking van persoonsgegevens bepaalt.
- "Apparaat" betekent elk apparaat dat toegang kan krijgen tot de Dienst, zoals een computer, een mobiele telefoon of een digitale tablet.
- "Persoonsgegevens" zijn alle gegevens die betrekking hebben op een geïdentificeerde of identificeerbare persoon. Voor de doeleinden van de AVG betekent Persoonsgegevens alle informatie met betrekking tot u, zoals een naam, een identificatienummer, locatiegegevens, online identificator of een of meer factoren die specifiek zijn voor de fysieke, fysiologische, genetische, mentale, economische, culturele of sociale identiteit.
- "Dienst" verwijst naar de Website.
- "Dienstverlener" betekent elke natuurlijke persoon of rechtspersoon die gegevens namens het Bedrijf verwerkt. Het verwijst naar derde bedrijven of individuen die door het Bedrijf zijn ingehuurd om de Dienst te faciliteren, om de Dienst namens het Bedrijf te leveren, om diensten met betrekking tot de Dienst uit te voeren of om het Bedrijf te helpen bij het analyseren van het gebruik van de Dienst. Voor de doeleinden van de AVG worden Dienstverleners beschouwd als Gegevensverwerkers.
- "Gebruiksgegevens" verwijst naar gegevens die automatisch worden verzameld, gegenereerd door het gebruik van de Dienst of door de Dienstinfrastructuur zelf (bijvoorbeeld de duur van een paginabezoek).
- "Website" verwijst naar Fitte bereikbaar via www.findyourfitte.com.
- "U", ook aangeduid als "uw", "websitebezoeker", "gebruiker", "consument", "klant", verwijst naar de individuele consument die toegang heeft tot of gebruikmaakt van de Dienst, of het bedrijf of andere juridische entiteit namens wie een dergelijke individuele toegang heeft tot of gebruikmaakt van de Dienst, zoals van toepassing. Onder de AVG (Algemene Verordening Gegevensbescherming) kan naar u worden verwezen als de Betrokkene of de Gebruiker, aangezien u de individuele gebruiker van de Dienst bent.

2. Uw Persoonsgegevens

Bij het gebruik van onze dienst kan Fitte u vragen om bepaalde persoonlijk identificeerbare informatie te verstrekken die kan worden gebruikt om contact met u op te nemen of u te identificeren. Persoonlijk identificeerbare informatie kan onder meer omvatten, maar is niet beperkt tot:

- Voornaam en achternaam

- Volledig adres: straatnaam en -nummer, provincie, postcode, stad, land

- E-mailadres

- Gebruiksgegevens

2.1 Gebruiksgegevens

Gebruiksgegevens worden automatisch verzameld bij het gebruik van de dienst. Gebruiksgegevens kunnen informatie bevatten zoals het internetprotocoladres van uw apparaat (bijv. IP-adres), browsertype, browserversie, de pagina's van onze dienst die u bezoekt, de tijd en datum van uw bezoek, de tijd die u op die pagina's hebt doorgebracht, unieke apparaatidentificatie en andere diagnostische gegevens.

Wanneer u toegang krijgt tot de dienst via een mobiel apparaat, kunnen we bepaalde informatie automatisch verzamelen, waaronder, maar niet beperkt tot, het type mobiel apparaat dat u gebruikt, uw unieke mobiele apparaat-ID, het IP-adres van uw mobiele apparaat, uw mobiele besturingssysteem, het type mobiele internetbrowser dat u gebruikt, unieke

apparaatidentificatie en andere diagnostische gegevens. We kunnen ook informatie verzamelen die uw browser verzendt wanneer u onze dienst bezoekt of wanneer u toegang krijgt tot de dienst via een mobiel apparaat.

2.2 Volgtechnologieën

We gebruiken cookies en vergelijkbare volgtechnologieën om de activiteit op onze dienst te volgen en bepaalde informatie op te slaan. Gebruikte volgtechnologieën zijn onder andere beacons, tags en scripts om informatie te verzamelen en bij te houden en om onze dienst te verbeteren en te analyseren. De technologieën die we gebruiken, kunnen omvatten:

- Cookies of browsercookies: een cookie is een klein bestand dat op uw apparaat wordt geplaatst. U kunt uw browser zo instellen dat alle cookies worden geweigerd of dat wordt aangegeven wanneer een cookie wordt verzonden. U heeft het recht om uw toestemming op elk moment aan te passen. U kunt dit doen via de knop "cookie-instellingen" aan de linkerkant onderaan het scherm, waar u elk type cookie kunt in- of uitschakelen. Essentiële cookies zijn noodzakelijk voor een werkende website en kunnen daarom niet worden uitgeschakeld. Als u echter geen cookies accepteert, kunt u mogelijk sommige delen van onze dienst niet gebruiken. Tenzij u uw browserinstelling hebt aangepast om cookies te weigeren, kan onze dienst cookies gebruiken.

- Webbeacon: Bepaalde delen van onze dienst en onze e-mails kunnen kleine elektronische bestanden bevatten die bekend staan als webbeacons (ook wel aangeduid als clear gifs, pixel tags en single-pixel gifs), die het bedrijf bijvoorbeeld in staat stellen om gebruikers te tellen die die pagina's hebben bezocht of een e-mail hebben geopend, en voor andere gerelateerde website-statistieken (bijvoorbeeld het registreren van de populariteit van een bepaalde sectie en het verifiëren van de integriteit van het systeem en de server).

3. Gebruik van uw Persoonsgegevens

Het Bedrijf kan Persoonsgegevens gebruiken voor de volgende doeleinden:

- Om onze Dienst te leveren en te onderhouden, inclusief het monitoren van het gebruik van onze Dienst.

- Voor het beheer van uw account: om uw registratie als gebruiker van de Dienst te beheren. De Persoonsgegevens die u verstrekt, geven u toegang tot verschillende functionaliteiten van de Dienst die beschikbaar zijn voor geregistreerde gebruikers.

- Voor de uitvoering van een overeenkomst: de ontwikkeling, naleving en uitvoering van de koopovereenkomst voor de producten, items of diensten die u via de Dienst hebt gekocht of enige andere overeenkomst met ons via de Dienst.

- Om contact met u op te nemen: om contact met u op te nemen via e-mail of andere equivalentie vormen van elektronische communicatie, zoals pushmeldingen van mobiele applicaties met betrekking tot updates of informatieve communicatie met betrekking tot de functionaliteiten, producten of gecontracteerde diensten, inclusief de beveiligingsupdates, wanneer nodig of redelijk voor hun implementatie.

- Om u nieuws, speciale aanbiedingen en algemene informatie te verstrekken over andere goederen, diensten en evenementen die wij aanbieden en die vergelijkbaar zijn met die welke u al hebt gekocht of waarnaar u hebt geïnformeerd, tenzij u ervoor hebt gekozen dergelijke informatie niet te ontvangen.

- Om uw verzoeken te beheren: om uw verzoeken aan ons bij te wonen en te beheren.

- Voor bedrijfsoverdrachten: we kunnen uw informatie gebruiken om een fusie, verkoop van bedrijfsmiddelen van het bedrijf, financiering of overname van ons bedrijf geheel of gedeeltelijk te evalueren of uit te voeren, hetzij als lopende zaak hetzij als onderdeel van faillissement, liquidatie of soortgelijke procedure, waarbij persoonsgegevens die wij over onze dienstgebruikers bewaren, tot de overgedragen activa behoren.

- Voor andere doeleinden: we kunnen uw informatie voor andere doeleinden gebruiken, zoals gegevensanalyse, het identificeren van gebruikstrends, het bepalen van de effectiviteit van onze promotiecampagnes en het evalueren en verbeteren van onze dienst, producten, marketing en uw ervaring.

We kunnen uw Persoonsgegevens delen in situaties zoals de volgende:

- Met Dienstverleners: we kunnen uw persoonlijke informatie delen met Dienstverleners om het gebruik van onze Dienst te monitoren en te analyseren, voor betalingsverwerking en om contact met u op te nemen.

- Voor bedrijfsoverdrachten: We kunnen uw persoonlijke informatie delen of overdragen in verband met of tijdens onderhandelingen over een fusie, verkoop van bedrijfsmiddelen van het Bedrijf, financiering of overname van ons bedrijf geheel of gedeeltelijk door een ander bedrijf.

- Met zakenpartners: We kunnen uw informatie delen met onze zakenpartners om bepaalde producten, diensten of promoties aan te bieden.

- Met uw toestemming: We kunnen uw persoonlijke informatie alleen voor andere doeleinden openbaar maken met uw toestemming.

3.1 Bewaring van uw Persoonsgegevens

Het Bedrijf zal uw Persoonsgegevens alleen bewaren zolang dit nodig is voor de doeleinden die worden uiteengezet in deze Privacyverklaring. We zullen uw Persoonsgegevens bewaren en gebruiken in de mate die nodig is om te voldoen aan onze wettelijke verplichtingen (bijvoorbeeld als we wettelijk verplicht zijn om uw gegevens te bewaren), geschillen op te lossen en onze juridische overeenkomsten en beleidsregels af te dwingen.

Het Bedrijf zal ook Gebruiksgegevens alleen intern bewaren voor analyse doeleinden. Gebruiksgegevens worden over het algemeen voor een kortere periode bewaard, behalve wanneer deze gegevens worden gebruikt om de beveiliging te versterken of de functionaliteit van onze Dienst te verbeteren, of wanneer wij wettelijk verplicht zijn om deze gegevens voor langere tijd te bewaren.

Als het Bedrijf wordt verzocht om enige Persoonsgegevens te verwijderen, zullen we in overeenstemming met de toepasselijke wetgeving op tijd reageren, maar zijn we afhankelijk van onze Gegevensverwerker (Wix Ltd.) voor uiteindelijke verwijdering.

3.2 Overdracht van uw Persoonsgegevens

Uw informatie, inclusief Persoonsgegevens, wordt verwerkt op de bedrijfslocaties van het Bedrijf en op andere plaatsen waar de bij de verwerking betrokken partijen zich bevinden. Dit betekent dat deze informatie kan worden overgedragen aan - en bewaard op - computers buiten uw staat, provincie, land of andere overheidsjurisdictie waar de gegevensbeschermingswetten kunnen verschillen van die in uw jurisdictie.

Uw toestemming voor deze Privacyverklaring, gevolgd door uw indiening van dergelijke informatie, vertegenwoordigt uw akkoord met die overdracht.

Het Bedrijf zal alle redelijkerwijs noodzakelijke stappen ondernemen om ervoor te zorgen dat uw gegevens veilig worden behandeld en in overeenstemming met deze Privacyverklaring, en er zal geen overdracht van uw Persoonsgegevens plaatsvinden aan een organisatie of een land, tenzij er adequate controles zijn, inclusief de beveiliging van uw gegevens en andere persoonlijke informatie.

3.3 Openbaarmaking van uw Persoonsgegevens

3.3.1 Bedrijfstransacties

Als het Bedrijf betrokken is bij een fusie, overname of verkoop van activa, kan uw Persoonsgegevens worden overgedragen. We zullen u op de hoogte stellen voordat uw Persoonsgegevens worden overgedragen en onderworpen aan een ander Privacybeleid.

3.3.2 Wetshandhaving

In bepaalde omstandigheden kan het Bedrijf verplicht zijn uw Persoonsgegevens bekend te maken als dit wettelijk verplicht is of in reactie op geldige verzoeken van openbare autoriteiten (bijv. een rechtbank of een overheidsinstantie).

3.3.3 Andere Wettelijke Vereisten

Het Bedrijf kan uw Persoonsgegevens openbaar maken in de oprechte overtuiging dat een dergelijke actie noodzakelijk is om te voldoen aan een wettelijke verplichting, de rechten of eigendommen van het Bedrijf te beschermen en te verdedigen, mogelijk wangedrag in verband met de Dienst te voorkomen of te onderzoeken, de persoonlijke veiligheid van gebruikers van de Dienst of het publiek te beschermen en te verdedigen tegen juridische aansprakelijkheid.

3.4 Beveiliging van uw Persoonsgegevens

De beveiliging van uw Persoonsgegevens is belangrijk voor ons, maar bedenk dat geen enkele methode van verzending via internet of elektronische opslag 100% veilig is. Hoewel we streven naar het gebruik van commercieel aanvaardbare middelen om uw Persoonsgegevens te beschermen, kunnen we de absolute beveiliging ervan niet garanderen.

3.5 Verwerking van uw Persoonsgegevens

De Dienstverleners die we gebruiken, hebben toegang tot uw Persoonsgegevens. Deze derde leveranciers verzamelen, bewaren, gebruiken, verwerken en overdragen informatie over uw activiteit op onze Dienst in overeenstemming met hun Privacybeleid.

3.5.1 Gegevensverwerker

De Dienstverleners die we gebruiken, hebben toegang tot uw Persoonsgegevens. Onze Dienst is afhankelijk van het platform van Wix Ltd, en zij treden op als onze Gegevensverwerker. De gegevens worden opgeslagen in datacenters in de VS, Ierland, Zuid-Korea, Taiwan en Israël. Verwerking vindt plaats in de EU, Israël en andere landen of gebieden die de EU heeft goedgekeurd.

3.5.2 Analyse

We gebruiken externe dienstverleners om het gebruik van onze Dienst te monitoren en te analyseren:

- Google Analytics

3.5.3 E-mailmarketing

We kunnen uw Persoonsgegevens gebruiken om contact met u op te nemen met nieuwsbrieven, marketing- of promotiemateriaal en andere informatie die voor u interessant kan zijn. U kunt zich op elk moment afmelden voor het ontvangen van een of alle van deze communicaties van ons door de afmeldlink of instructies te volgen die worden verstrekt in elke e-mail die we verzenden of door contact met ons op te nemen.

3.5.4 Betalingen
Wij bieden betaalde producten en/of diensten binnen de dienst en daarom maken we gebruik van diensten van derden voor de verwerking van betalingen (bijv. betalingsverwerkers). Wij zullen uw betaalkaartgegevens niet opslaan of verzamelen. Die informatie wordt rechtstreeks verstrekt aan onze betalingsverwerkers van derden, waarvan het gebruik van uw persoonlijke informatie wordt geregeld door hun Privacybeleid. Deze betalingsverwerkers houden zich aan de normen die zijn vastgesteld door PCI-DSS, beheerd door de PCI Security Standards Council, een gezamenlijke inspanning van merken zoals Visa, Mastercard, American Express en Discover. PCI-DSS-vereisten helpen ervoor te zorgen dat betalingsinformatie veilig wordt verwerkt. Dergelijke dienstverleners van derden kunnen zijn:

• MasterCard
• PayPal
• iDeal
• Klarna

3.5.5 Transport en logistiek
We maken gebruik van dienstverleners van derden om onze producten aan u te leveren. Daarom delen we enkele van uw Persoonsgegevens met hen, zoals naam en adres, om uw Bestelling te kunnen vervullen. Alle betrokken vervoerders treden op als onafhankelijke gegevensbeheerders, verantwoordelijk voor de verwerking van uw Persoonsgegevens. In geval van vragen met betrekking tot hoe zij uw Persoonsgegevens verwerken, raadpleeg de privacyverklaring op de website van de desbetreffende vervoerder. U kunt de vervoerder die uw levering uitvoert vinden in de meldingsmail over de status van uw Bestelling. Dergelijke dienstverleners van derden kunnen zijn:

4. GDPR

4.1 Wettelijke Grondslag voor de Verwerking van Persoonsgegevens onder de GDPR
Wij kunnen Persoonsgegevens verwerken onder de volgende voorwaarden:
• Toestemming: u heeft toestemming gegeven voor de verwerking van Persoonsgegevens voor één of meerdere specifieke doeleinden.
• Uitvoering van een overeenkomst: het verstrekken van Persoonsgegevens is noodzakelijk voor de uitvoering van een overeenkomst met u en/of voor eventuele precontractuele verplichtingen daarvan.
• Wettelijke verplichtingen: het verwerken van Persoonsgegevens is noodzakelijk voor naleving van een wettelijke verplichting waaraan het Bedrijf is onderworpen.
• Vitale belangen: het verwerken van Persoonsgegevens is noodzakelijk om uw vitale belangen of die van een andere natuurlijke persoon te beschermen.
• Publieke belangen: het verwerken van Persoonsgegevens houdt verband met een taak die wordt uitgevoerd in het algemeen belang of in de uitoefening van officiële autoriteit die aan het Bedrijf is toegekend.
• Gerechtvaardigde belangen: het verwerken van Persoonsgegevens is noodzakelijk voor de doeleinden van de gerechtvaardigde belangen die door het Bedrijf worden nagestreefd.

In elk geval zal het Bedrijf u graag helpen om de specifieke wettelijke grondslag die van toepassing is op de verwerking te verduidelijken, met name of de verstrekking van Persoonsgegevens een wettelijke of contractuele verplichting is, of een vereiste om een overeenkomst aan te gaan.

4.2 Uw Rechten Onder de GDPR
Het Bedrijf verbindt zich ertoe de vertrouwelijkheid van uw Persoonsgegevens te respecteren en u de mogelijkheid te bieden uw rechten uit te oefenen. U heeft onder dit Privacybeleid en volgens de wet, als u zich in de EU bevindt, het recht om:
• Toegang te vragen tot uw Persoonsgegevens. Het recht om toegang te vragen tot, uw informatie bij te werken of te laten verwijderen die we over u hebben. Wanneer mogelijk kunt u direct binnen uw accountinstellingen toegang krijgen tot, bijwerken of verwijdering van uw Persoonsgegevens aanvragen. Als u deze handelingen zelf niet kunt uitvoeren, neem dan contact met ons op voor assistentie. Dit stelt u ook in staat om een kopie te ontvangen van de Persoonsgegevens die we over u bewaren.
• Correctie van de Persoonsgegevens die we over u bewaren aan te vragen. U heeft het recht om onvolledige of onjuiste informatie die we over u bewaren te laten corrigeren.
• Bezwaar te maken tegen de verwerking van uw Persoonsgegevens. Dit recht bestaat wanneer we vertrouwen op gerechtvaardigd belang als de wettelijke basis voor onze verwerking en er iets in uw specifieke situatie is waardoor u bezwaar wilt maken tegen onze verwerking van uw Persoonsgegevens op deze grond. U heeft ook het recht om bezwaar te maken wanneer we uw Persoonsgegevens verwerken voor directmarketingdoeleinden.
• Verwijdering van uw Persoonsgegevens aan te vragen. U heeft het recht om ons te vragen uw Persoonsgegevens te wissen of te verwijderen wanneer er geen goede reden is om de verwerking ervan voort te zetten.
• Overdracht van uw Persoonsgegevens aan te vragen. Wij zullen uw Persoonsgegevens aan u of aan een door u gekozen derde verstrekken in een gestructureerd, veelgebruikt en machinaal leesbaar formaat. Houd er rekening mee dat dit recht alleen van toepassing is op geautomatiseerde informatie waarvoor u aanvankelijk toestemming heeft gegeven om deze te gebruiken of waarvoor we de informatie hebben gebruikt om een overeenkomst met u uit te voeren.
• Uw toestemming in te trekken. U heeft het recht om uw toestemming voor het gebruik van uw Persoonsgegevens in te trekken. Als u uw toestemming intrekt, kunnen we u mogelijk geen toegang verlenen tot bepaalde specifieke functionaliteiten van de Dienst.

4.3 Uitoefening van Uw GDPR Gegevensbeschermingsrechten
U kunt uw rechten van toegang, rectificatie, verwijdering en bezwaar uitoefenen door contact met ons op te nemen. Houd er rekening mee dat we u kunnen vragen uw identiteit te verifiëren voordat we op dergelijke verzoeken reageren. Als u een verzoek indient, zullen we ons best doen om zo snel mogelijk te reageren. U heeft het recht om een klacht in te dienen bij een Toezichthoudende Autoriteit voor Gegevensbescherming over onze verzameling en gebruik van uw Persoonsgegevens. Voor meer informatie kunt u, als u zich in de Europese Economische Ruimte (EER) bevindt, contact opnemen met de lokale toezichthoudende autoriteit voor gegevensbescherming in de EER.

5. Privacy van Kinderen

Onze Dienst is niet bedoeld voor personen jonger dan 13 jaar. We verzamelen niet bewust persoonlijk identificeerbare informatie van personen jonger dan 13 jaar. Als u een ouder of voogd bent en u zich ervan bewust bent dat uw kind ons Persoonsgegevens heeft verstrekt, neem dan contact met ons op. Als we ons ervan bewust worden dat we Persoonsgegevens hebben verzameld van personen jonger dan 13 jaar zonder verificatie van ouderlijke toestemming, zullen we stappen ondernemen om die informatie van onze servers te verwijderen. Als we voor de verwerking van uw informatie afhankelijk moeten zijn van toestemming als wettelijke basis en uw land toestemming van een ouder vereist, kunnen we de toestemming van uw ouder vereisen voordat we die informatie verzamelen en gebruiken.

6. Links naar Andere Websites

Onze Dienst kan links bevatten naar andere websites die niet door ons worden beheerd. Als u op een link van een derde partij klikt, wordt u naar de website van die derde partij geleid. We raden u ten zeerste aan het Privacybeleid van elke website die u bezoekt te bekijken. We hebben geen controle over en nemen geen verantwoordelijkheid voor de inhoud, privacybeleidsregels of praktijken van andere websites van derden.

7. Wijzigingen in dit Privacybeleid

We kunnen ons Privacybeleid van tijd tot tijd bijwerken. We zullen u op de hoogte stellen van eventuele wijzigingen door het nieuwe Privacybeleid op deze pagina te plaatsen. We zullen u ook informeren via e-mail en/of een opvallende kennisgeving op onze Dienst voordat de wijziging van kracht wordt en de "Laatst bijgewerkt" datum bovenaan dit Privacybeleid bijwerken. U wordt geadviseerd om dit Privacybeleid periodiek te controleren op wijzigingen. Wijzigingen in dit Privacybeleid zijn van kracht wanneer ze op deze pagina worden geplaatst.
